Prohibits the use of state boating facilities and state parks to operate shark tours effective July 1, 2010

Bans the use or transportation of diving cages (floating, bottom, or similar devices) in state waters intended to place humans in close proximity with sharks or within known shark habitats

Allows the Department of Land and Natural Resources to issue permits for activities otherwise prohibited by this section in accordance with section 187A-6 or other applicable law

Exempts shark tours already operating on the north shore of Oahu prior to July 1, 2010 from the prohibitions

Defines "shark tour" as engaging in actions relating to sharks for compensation, including guide services, charters, tours, and transportation
