Creates new criminal offense for trespass on properties listed on the Hawai`i Register of Historic Places, increasing penalties to the next highest level compared to standard trespass violations under existing statutes.

Creates new criminal offense for property damage to historic sites listed on the Hawai`i Register of Historic Places, increasing penalties to the next highest level compared to standard vandalism violations under existing statutes.

Applies enhanced penalties in addition to all elements required for conviction under existing trespass and property damage statutes (sections 708-813 through 708-815 for trespass; sections 708-821 through 708-823 for property damage).

Does not apply to criminal proceedings or penalties incurred before the act's effective date.

Takes effect upon approval.
