HB723 - Off-Highway Motor Vehicles

• Amends Hawaii Revised Statutes Section 708-815 to classify unauthorized operation of off-highway motor vehicles on another's land as simple trespass.

• Defines "off-highway motor vehicle" to include motorcycles designed for off-highway operation and motor vehicles with three or more wheels designed for off-highway terrain (ATVs, dune buggies), but excludes emergency vehicles.

• Creates three categories of simple trespass: unlawfully entering or remaining on premises, operating an off-highway motor vehicle on another's land without permission, or operating an off-highway motor vehicle without authorization in a public park or recreational ground.

• Establishes that simple trespass involving off-highway motor vehicles is punishable by fine and potential forfeiture of the vehicle (specific fine amount left blank in bill).

• Takes effect upon approval and does not affect rights, penalties, or proceedings that occurred before the effective date.
