Creates a new chapter in Hawaii Revised Statutes establishing definitions and legal protections for all terrain vehicle (ATV) activities.

Defines "all terrain vehicle" as a motor vehicle with low pressure tires, straddled seat, handlebars for steering, and designed to handle varied terrain.

Establishes a rebuttable presumption that injuries or deaths from ATV use were not caused by negligence of the ATV activity sponsor, their employees, or agents if caused solely by inherent risks of the vehicle.

Allows injured persons or their legal representatives to rebut the presumption of no negligence by presenting a preponderance of evidence.

Takes effect upon approval and does not affect rights, duties, or proceedings that existed before the effective date.
