HB 901 Summary

• Establishes a "global settlement" framework offering the Office of Hawaiian Affairs $251 million in payments plus conveyance of approximately 20% of the state's 1.8 million acres of public trust lands to resolve all past and future claims related to the public land trust from November 7, 1978 onward.

• If the Office of Hawaiian Affairs rejects the global settlement by January 1, 2010, provides an alternative option to receive $200 million in resources through monetary payment, conveyance of specified real property parcels, or a combination of both.

• Authorizes the Director of Finance to issue general obligation bonds up to $251 million (Part I) or $200 million (Part II) to fund the monetary payments as approved by the legislature.

• Conveys ten categories of public lands to the Office of Hawaiian Affairs including Kakaako Makai, Kahana Valley, La Mariana Pier, Mauna Kea parcels, state fishponds, and other specified properties, with the Office retaining the right to inspect and reject properties.

• Withdraws the State's waiver of sovereign immunity for suits regarding public land trust income and proceeds, and excludes lands conveyed to the Office of Hawaiian Affairs from the definition of "public lands" in state law.
