HB 906 Summary

• Establishes the Makua Valley Reserve Commission within the Department of Land and Natural Resources to oversee general administration of Makua Valley on Oahu.

• Designates Makua Valley for exclusive use for native Hawaiian cultural, spiritual, and subsistence practices; archaeological and environmental preservation; habitat restoration; and education, with commercial uses strictly prohibited.

• Creates a 10-member commission with representatives from specified Hawaiian organizations (Malama Makua, Hui Malama O Makua, Koa Mana), evicted families, the Waianae coast community, Office of Hawaiian Affairs, U.S. Army, state adjutant general, board of land and natural resources chair, and native Hawaiian organizations.

• Establishes the Makua Valley Rehabilitation Trust Fund to receive federal moneys for rehabilitation, legislative appropriations, and administrative fine proceeds; fund repeals July 1, 2045.

• Sets penalties for violations including criminal penalties (up to $1,000 fine or 30 days imprisonment) and administrative fines up to $25,000 for repeated violations, plus up to $5,000 per damaged natural resource or historic property.
