H.C.R. No. 43 Summary

• Requests the State Auditor to perform a sunrise analysis of proposed regulation of the archaeology profession under the Department of Commerce and Consumer Affairs.

• Requires the Auditor to consult with the State Historic Preservation Division, Society for Hawaiian Archaeology, University of Hawaii School of Anthropology, Island Burial Councils, Office of Hawaiian Affairs, and Hui Malama I Na Kupuna O Hawaii Nei during the analysis.

• Directs the Auditor to assess the probable effects of the proposed regulation and determine consistency with state regulatory policies under section 26H-2, Hawaii Revised Statutes, and identify alternative forms of regulation.

• Requires the Auditor to transmit findings to the Legislature no later than twenty days before the 2011 Legislative Session begins.

• Mandates transmittal of certified copies to the Governor, Director of Commerce and Consumer Affairs, Board of Land and Natural Resources, Office of Hawaiian Affairs, and other stakeholder organizations.
