Authorizes the Board of Land and Natural Resources to cancel Non-Exclusive Easement S-5252 and issue a new 65-year non-exclusive easement over state submerged lands at Lapaakea, Lahaina, Maui (tax map key (2) 4-5-001:055).

Covers 1,310 square feet of state submerged lands seaward of tax map key (2) 4-5-001:006 where Lakala Trust owns property with wooden decks and concrete piers constructed in the 1920s.

The original easement S-5252 was issued May 25, 1992 through May 24, 2012 for maintenance and repair of the decks and piers; cancellation and reissuance is required to allow property refinancing.

The Land Board approved this request on August 28, 2009 under agenda item D-15; section 171-53, Hawaii Revised Statutes requires prior legislative authorization to lease state submerged lands.

Requires transmission of certified copies of the resolution to the Chairperson of the Board of Land and Natural Resources.
