Urges the Department of Education to develop and implement a statewide plan to eliminate waste of milk distributed with school lunches by the 2010-2011 school year using existing resources.

Requires the Department of Education to report to the legislature no later than 60 days prior to the first day of instruction for the 2010-2011 school year detailing current milk waste amounts, the elimination plan, and estimated cost savings.

Notes that federal law (42 U.S. Code 1758) requires schools participating in the National School Lunch Program to offer students fluid milk in varying fat contents.

Identifies that few Hawaii public school students receive milk substitutions or waivers, and conditions like lactose intolerance do not currently qualify students for exemptions.

Directs certified copies of the resolution be transmitted to the Superintendent of Education, Chairperson of the Board of Education, and Director of Health.
