Prohibits employers from hiring unauthorized aliens, as defined under federal law (title 8 United States Code section 1324a(h)(3)).

Requires the Department of Labor to notify the state attorney general and U.S. Immigration and Customs Enforcement upon receipt of allegations of unauthorized alien employment and conduct investigations.

Authorizes suspension of an employer's professional or vocational license under chapter 436B and levies administrative fines for violations, with federal penalties taking precedence if federal enforcement occurs.

Requires unauthorized aliens employed in violation to be terminated by operation of law, taken into custody if appropriate, and referred to federal authorities; subjects them to prosecution for identity theft in the third degree under section 708-839.8.

Defines "employer" to include construction contractors and agricultural employers, and "employ an unauthorized alien" to mean hiring, recruiting, or referring for employment any alien without legal authorization to work in the United States.
