SB 2099 Summary

• Amends Hawaii Revised Statutes Section 323D-43 to add specific certificate of need requirements for renal dialysis facilities.

• Requires proposed renal dialysis facilities to achieve a projected utilization rate of at least 75 percent by the third year of operation to obtain a certificate of need.

• Requires all other existing renal dialysis facilities in the same health service area to maintain at least 80 percent utilization rates for a new facility to be approved.

• Defines full utilization as a minimum of 3.5 treatments per dialysis station per day and establishes 6 dialysis stations as the optimum facility size.

• Effective July 1, 2010 and repeals on June 30, 2013.
