Removes "place of burial" from the intentional desecration offense under Hawaii Revised Statutes section 711-1107(1)(b), leaving only public monuments, structures, places of worship, and national flags as intentional offenses.

Creates new offense of negligent desecration of a place of burial, allowing conviction based on negligent conduct rather than requiring intentional acts.

Maintains existing penalties of up to one year imprisonment, a fine of up to $10,000, or both for desecration convictions.

Provides that the Act does not affect rights, duties, penalties, or proceedings that occurred before the effective date.

Takes effect upon approval.
