Prohibits employers and labor organizations from discharging, barring from employment, withholding pay from, or demoting employees for using accrued and available sick leave.

Requires written validation from a physician if an illness or injury requires use of more than one day of accrued and available sick leave.

Allows employers to mandate medical evaluation by a physician from an employer-provided list of at least three physicians if an employee uses sick leave three times over a six-month period.

Exempts employers and labor organizations from these prohibitions if their actions comply with provisions of a valid negotiated attendance policy.

Amends Hawaii Revised Statutes section 378-32 regarding unlawful employment practices and takes effect upon approval.
