SB 2423 Summary

• Amends Hawaii Revised Statutes sections 514A-13.4 and 514B-140 to authorize condominium boards of directors to install, lease, or license solar energy and wind energy devices on common elements of condominium projects.

• Solar and wind energy devices cannot be installed on limited common elements without consent of affected unit owners, and installations must not directly affect nonconsenting unit owners.

• Defines "solar energy device" as facilities that use solar energy for heating, cooling, or reducing fossil fuel energy use, excluding skylights and windows.

• Defines "wind energy device" as facilities that use wind energy to produce electricity or reduce fossil fuel-dependent energy use, and must be fully installed and operational to qualify.

• Establishes that installation of these renewable energy devices on common elements does not constitute a structural alteration or material change to the condominium project plans.
