HI SB2450

Establishes a new civil violation (not criminal) for intentional or knowing possession of one ounce or less of marijuana, with a fine not to exceed $300 for the first violation and $500 for each subsequent violation.

Directs civil fines and penalties from marijuana violations to be deposited into the early intervention special fund and administered pursuant to section 321-355.

Exempts possession of one ounce or less of marijuana from triggering mandatory substance abuse treatment requirements for parolees and probationers, which now only apply to possession of more than one ounce.

Clarifies that mere possession of one ounce or less of marijuana near schools or public parks does not constitute possession with intent to distribute without additional conduct indicating such intent.

Effective date: July 1, 2050.
