S.B. 2520 Summary

• Amends Section 208 of the Hawaiian Homes Commission Act, 1920 to add new paragraph (9) authorizing native Hawaiian lessees to sublease a portion of their leasehold land to renewable energy producers.

• Sublease term cannot extend beyond the original lessee's lease term and is limited to a maximum of 65 years.

• Sublessee must indemnify and hold harmless the lessee, department, and State of Hawaii from all claims arising from activities on the subleased land and maintain sufficient insurance coverage.

• Subleased land remains subject to withdrawal by the department at any time with reasonable notice; upon withdrawal, the sublessee's rent is reduced proportionally and they receive compensation for permanent improvements or may remove and relocate their improvements.

• Effective July 1, 2010.
