Amends section 205-4.5 of Hawaii Revised Statutes to add a 1,000-foot setback requirement for wind energy facilities in agricultural districts with Class A or B soil productivity ratings.

Wind turbine generators with capacity of one megawatt or more must be located no less than 1,000 feet from the nearest off-site residential dwelling unit, measured from the center of the turbine to the exterior of the residence.

The 1,000-foot distance applies to residential dwellings that existed at the time of the permit application.

Wind energy facilities remain permitted uses in agricultural districts provided they are compatible with agricultural uses and cause minimal adverse impact on agricultural land.

Effective date of July 1, 2050.
