• Prohibits persons under 18 years old from purchasing cans of spray paint, with retailers required to verify age through photo identification containing photograph, date of birth, name, signature, and address.

• Requires retailers to restrict spray paint display to areas not accessible to customers (behind counter or locked cases) and may only display empty cans on shelves for examination.

• Mandates retailers maintain electronic logs of all spray paint sales including purchaser information, identification type, and paint details (brand, color, size, quantity), electronically transmitted to the Department of Public Safety at least monthly and retained for two years.

• Establishes retailer registration requirement with the Department of Public Safety by February 1, 2011, with a $100 per day fine for non-compliance, plus a registration fee to cover software costs.

• Imposes civil fines of $500 per can (up to ten cans) and $1,000 per can (over ten cans) for retailers violating sales restrictions; requires wholesalers to report monthly spray paint sales to retailers.

• Effective July 1, 2010, with purchase and logging provisions effective January 1, 2011.
