Prohibits the Public Utilities Commission from approving certificates of public convenience and necessity for new electric generation units larger than 2 megawatts that can only use fossil fuels, effective July 1, 2010.

Allows exceptions if the applicant is an electric utility company that demonstrates compliance with renewable portfolio standards and if annual heat input from biomass fuels exceeds heat input from fossil fuels.

Defines "new electric generation unit" as a unit without an air permit seeking PUC approval after June 30, 2010, excluding retrofits of existing units.

Prohibits electric utility companies from entering agreements to purchase electricity from fossil-based generation units built after December 31, 2010, unless biomass fuel heat input exceeds fossil fuel heat input.

Maintains existing renewable portfolio standards requiring utilities to source 10% renewable energy by 2010, 15% by 2015, 25% by 2020, and 40% by 2030.
