S.B. 2771 Summary

• Transfers ownership and management of Kalawao county from the Department of Health (DOH) and Department of Land and Natural Resources (DLNR) to the Department of Hawaiian Home Lands (DHHL) when no persons are receiving care for Hansen's disease at Kalaupapa Settlement.

• Transferred lands in Kalawao county shall not attain the status of Hawaiian home lands as defined in the Hawaiian Homes Commission Act, 1920.

• Removes DOH jurisdiction over Kalawao county and eliminates the sheriff position and related law enforcement structures currently governed by DOH.

• Prohibits Maui county from exercising any authority, including zoning authority, over Kalawao county.

• Requires DHHL to transfer all received lands and authority to a recognized sovereign native Hawaiian entity if one is federally and state-recognized; effective July 1, 2050, or upon actual transfer of lands from DOH and DLNR to DHHL.
