S.B. 2883 Summary

• Amends Hawaii Revised Statutes Section 378-32 to prohibit employers and labor organizations from barring, discharging, withholding pay from, or demoting employees solely for legitimately using accrued and available negotiated sick leave in accordance with employer policies.

• Applies only to employers with 100 or more employees who have a collective bargaining agreement with their employees.

• Allows employers to take adverse action against employees if they are unable to fulfill essential job functions or requirements of their position.

• Exempts cases involving abuse of sick leave from the protections afforded to employees.

• Takes effect on July 1, 2010.
