Transfers appointment authority for the superintendent of education from the board of education to the governor, subject to senate advice and consent.

Superintendent serves a term expiring at the end of the governor's elected term and may be removed by the governor at any time.

Superintendent remains exempt from state residency requirements and vacancies are filled for the unexpired balance of the term per Article V, section 6 of the Hawaii Constitution.

Removes the board of education's power to appoint and remove the superintendent while retaining its authority to formulate educational policy and adopt performance standards.

Takes effect upon approval and compliance with Article XVII, section 3 of the Hawaii Constitution, pending constitutional amendment ratification.
