Authorizes the Board of Land and Natural Resources to cancel Non-Exclusive Easement S-5252 and issue a new 65-year non-exclusive easement for state submerged lands at Lapaakea, Lahaina, Maui.

Covers 1,310 square feet of state submerged lands identified as tax map key (2) 4-5-001:055, seaward of tax map key (2) 4-5-001:006.

The original easement S-5252 was approved by the Land Board on May 11, 1990, and ran from May 25, 1992 through May 24, 2012 for maintenance and repair of wooden decks and concrete piers at 839 Front Street.

Lakala Trust requires cancellation and reissuance of the easement to refinance the property mortgage, as recommended by the Department of Land and Natural Resources on August 28, 2009.

Legislative authorization is required under Hawaii Revised Statutes section 171-53, which mandates prior approval of the Governor and prior authorization by concurrent resolution to lease state submerged lands.
