Department of Human Services must examine and evaluate the financial viability and effectiveness of requiring substitute caregivers to be certified nurse aides when a third client is cared for in community care foster family homes.

Current regulations require substitute caregivers providing three or more hours of daily services to be nurse aides, a requirement triggered when homes accept a third client under discretionary authority granted in 2007.

Department must assess the requirement's effects on client safety and health, the financial viability of home operators, and any unintended consequences.

Director of Human Services must submit a report with findings, recommendations, and any proposed legislation to the Legislature no later than twenty days before the 2011 Regular Session convenes.
