Allows the Hawaii Criminal Justice Data Center to indefinitely retain fingerprints of employment and licensing applicants who undergo criminal history record checks authorized by state law.

Requires agencies conducting criminal history record checks to notify applicants and employees that their fingerprints will be retained by the Hawaii Criminal Justice Data Center.

Enables implementation of a statewide "Rap Back" program that notifies employers and licensing agencies if applicants are arrested after being hired or licensed, providing up-to-date criminal history information.

Establishes that retained fingerprints and related information shall be kept separate from criminal identification records and accessible only to authorized entities listed in statute or persons authorized by the attorney general.

Takes effect July 1, 2011.
