Amends Hawaii Revised Statutes section 206E-33 to require that costs of providing public facilities in the Kakaako makai area be assessed as a condition of developing real property in the Kakaako mauka area.

Modifies section 206E-35 to clarify that the Hawaii Community Development Authority must include provisions for public facility costs when collaborating with the Kakaako makai community planning advisory council on development plans.

Establishes that development in the Kakaako mauka area (where most development activities occur) shall fund public facilities in the Kakaako makai area (designated as a community gathering place and public benefit area).

Addresses findings from Act 144 (2009) which emphasized public participation in Kakaako makai development and the vision for a community gathering place with scenic shoreline open space.

Takes effect upon approval.
