Exempts construction of nonresidential agricultural and aquacultural structures from county building permit requirements if conditions are met.

Owner/occupier must obtain third-party certification that proposed building plans comply with all applicable codes and county/state requirements.

Owner/occupier must submit building plans, indemnification agreement, and third party certification to county planning department and agree to defend and indemnify the State and counties from all liability arising from the lack of building permits.

Exemption applies only to nonresidential structures with floor area of 1,500 square feet or less located on properties of at least 3 acres.

Legislation requires the Hawaii Farm Bureau Federation and each county planning department to report to the legislature by 20 days before the 2012 regular session regarding the Act's impact and any proposed amendments.
