Amends Chapter 353 of Hawaii Revised Statutes to add requirements for contracts with privately owned prisons or out-of-state detention facilities that hold state prisoners or detainees.

Requires state contracts with private prisons or out-of-state detention facilities to provide access to the same information that Chapter 92F (freedom of information law) requires from the Department of Public Safety.

Mandates that contracts include the same remedies for contractor non-compliance with information disclosure requirements that Chapter 92F provides for government agency violations.

Defines "privately owned prison" and "out-of-state detention facility" as any such facility incarcerating or detaining prisoners under contract with the State.

Effective date: July 1, 2011.
