Operators of uninsured motor vehicles involved in accidents in Hawaii are prohibited from suing any other person for injuries or death resulting from the accident.

Passengers in uninsured motor vehicles involved in accidents may only sue the operator of that uninsured vehicle for their injuries or death, not other parties.

These restrictions apply regardless of whether the operator or passenger knew the vehicle was uninsured at the time of the accident.

Repeals section 431:10C-118, which previously allowed uninsured persons to bring tort actions upon payment of a $1,000 fee in lieu of criminal penalties.

Takes effect upon approval.
