Repeals Act 17, Special Session Laws of Hawaii 2009, which provided a five percent bid reduction for public works contracts awarded to bidders with registered apprenticeship programs.

HUD determined on September 16, 2010 that Act 17 violates federal procurement regulations at 24 CFR 85.36(c)(2), which prohibit in-state or local geography preferences in bid evaluation for community planning and development funded projects.

Legislature finds that repealing Act 17 is in the best interests of the State due to conflicts with federal law and potential violations of additional federal programs pending HUD's Office of General Counsel determination.

Takes effect upon approval.
