Authorizes the superintendent of education to reconstitute public schools (excluding charter schools) that have been in restructuring for four or more school years without significant academic improvement, as determined by statistical analysis of academic data.

Requires consideration of student proficiency in reading and math, interventions being used, number of highly qualified teachers, professional development, and input from school faculty, staff, specialists, and school community councils before reconstitution.

Permits the superintendent to replace all or most school staff, contract with private entities to manage schools, and change school community council membership as part of reconstitution.

Requires the department to negotiate with unions regarding reassignment of affected employees to other qualified positions and to follow current hiring and recruiting procedures for new employees at reconstituted schools.

Allows the superintendent to recommend reconstitution actions and charter revocation to the charter school review panel for charter schools meeting the same restructuring criteria, with the board of education to adopt necessary rules.
