Prohibits operating a motor vehicle on public streets, roads, or highways while using a handheld wireless communication device for text messaging, email, or internet access.

Creates exceptions allowing handheld device use during medical emergencies, reporting safety hazards or criminal activity, providing roadside/medical assistance, using voice-operated or hands-free technology, or by law enforcement and emergency personnel in performance of duties.

Establishes petty misdemeanor as base penalty, escalating to misdemeanor if person has prior conviction within three years, class C felony if violation causes substantial or serious bodily injury, and class B felony if violation causes death.

Defines "handheld wireless communication device" to include wireless telephones, personal digital assistants, pagers, and text messaging devices.

Takes effect upon approval with no retroactive application to violations occurring before enactment.
