HI HCR153

Urges planned community associations to allow members and bona fide tenants to display United States or State of Hawaii flags on residential dwellings with a maximum shaft length of six feet and flag size not exceeding three feet by five feet.

Directs association boards to refrain from assessing fees, fines, or penalties against members or tenants for displaying flags meeting these specifications.

Requires flags displayed under this resolution to be positioned prominently on the dwelling and comply with Title 4, United States Code, Chapter 1 (for U.S. flags) and Hawaii Revised Statutes Section 5-19 (for state flags).

Addresses ongoing disputes in planned communities where association boards have denied flag displays and imposed fines or large fees against members.

Directs transmission of certified copies to the Governor and Hawaii First - Community Association Management.
