H.C.R. NO. 29 Summary

• Authorizes the Board of Land and Natural Resources to issue a non-exclusive easement for 55 years covering approximately 69 square feet of state-owned submerged land in Lahaina, Maui (tax map key (2) 4-6-3, seaward of :5).

• Grants Christine K. Ho (as Trustee of the Christine K. Ho Living Trust) the right to use, maintain, repair, replace, and remove an existing seawall that encroaches onto the state submerged land.

• Requires Ho to pay a one-time fee based on fair market rent to be determined by independent or staff appraisal and subject to approval by the Board of Land and Natural Resources Chairperson.

• Easement issuance is conditioned upon limitations and conditions to be determined by the Board of Land and Natural Resources and is necessary for Ho to obtain a county building permit to remodel the residence and renovate the seawall.

• Directs transmission of a certified copy of the resolution to the Chairperson of the Board of Land and Natural Resources.
