HCR 40 Summary

• Requests the Public Utilities Commission to evaluate the feasibility of incorporating community solar gardens into Hawaii's net energy metering law.

• Directs the PUC to use Colorado's community solar garden law (section 40-2-124, Colorado Revised Statutes) as a model for potential Hawaii implementation.

• Community solar gardens would allow renters, low-income earners, and others without property ownership or sufficient funds to participate in solar electricity generation and net energy metering.

• Requires the PUC to submit findings, recommendations, and any proposed legislation to the Legislature no later than twenty days before the 2012 Regular Session convenes.

• Directs certified copies be transmitted to the PUC Chairperson, Director of Commerce and Consumer Affairs, and Director of Business, Economic Development, and Tourism.
