Request the State Auditor to conduct a comprehensive study on the implementation and effectiveness of Act 10, Session Laws of Hawaii 2008, which established the Information Privacy and Security Council to address identity theft and personal information security.

Direct the Auditor to analyze four specific proposals for providing remedies to persons affected by security breaches: requiring independent audits at organizational expense, establishing an agency to track identity theft trends, creating a centralized trust account funded by fees on liable organizations, and establishing a statutory private right of action.

Require the Information Privacy and Security Council to cooperate with and assist the Auditor in conducting the study.

Mandate the Auditor submit findings, recommendations, and any proposed legislation to the Legislature no later than twenty days before the convening of the 2012 Regular Session.
