H.R. NO. 98 - State Health Planning and Development Agency Investigation

• Request the Attorney General to establish a special task force to investigate the State Health Planning and Development Agency for possible violations of the Hawaii Administrative Procedure Act and sunshine law (open meetings law).

• Task force composition to be determined by the Attorney General to fairly represent all interested stakeholders, with the Attorney General serving as chairperson.

• Task force to convene during the 2011 legislative interim with proceedings to terminate on June 30, 2012, and all proceedings subject to chapter 92, Hawaii Revised Statutes (sunshine law).

• Attorney General to submit a report of findings and recommendations, including any proposed legislation, to the Legislature not later than twenty days prior to the 2012 Regular Session.

• Investigation focuses on potential violations related to approval of the state health services and facilities plan and adoption of capacity threshold rules that may have affected certificate of need decisions and healthcare availability in rural or underserved areas.
