HI SB1025

Adds assault of firefighters and water safety officers engaged in performance of duty to assault in the second degree offenses under HRS § 707-711(1)(h).

Defines "firefighter" per HRS § 710-1012 and "water safety officer" as public servants employed by the United States, State, or county as lifeguards or persons authorized to conduct water rescue or ocean safety functions.

Creates new class B felony for unauthorized entry in a dwelling in the first degree when occupant lawfully present is 62 years or older, incapacitated, or has a developmental disability.

Redesignates existing unauthorized entry in a dwelling as "second degree" and removes "reckless disregard" language requirement, maintaining it as a class C felony.

Affirmative defense available for both first and second degree unauthorized entry charges if defendant was joining an invited social gathering with no intent to commit other unlawful acts.
