SB 1221 Summary

• Requires contractors to ensure Hawaii residents compose at least 80% of the workforce on construction projects, with the option to withdraw bids without penalty prior to contract award if unable to comply.

• Shifts certification of compliance from monthly basis to submission with notice of final completion of contract, signed by officers of both general contractors and applicable subcontractors.

• Limits sanctions for non-compliance to withholding final payment from general contractors and proceedings for debarment or suspension for both general contractors and subcontractors.

• Protects general contractors from sanctions due to noncompliance by their subcontractors on the same contract.

• Effective July 1, 2011.
