HI SB1294

Repeals Hawaii Revised Statutes section 352-28, which authorized transferring youth ages 16 and older from state youth correctional facilities to adult correctional facilities.

Eliminates the director's authority to transfer youth to adult facilities for disrupting order, injuring staff or other persons, or for other good cause with family court approval.

Removes provisions allowing family court to order a youth's return to a youth correctional facility if they demonstrate improvement or progress while in adult custody.

Takes effect on July 1, 2011.
