Requires all businesses in Hawaii to charge customers a 10-cent fee for each single-use checkout bag starting January 1, 2012

Exempts customers participating in federally-approved nutrition assistance programs (SNAP, WIC) from the checkout bag fee

Allows businesses to retain 20 percent of collected fees (subject to income and general excise taxes) and requires remittance of remaining 80 percent to the Department of Health monthly, or quarterly for small businesses earning $250,000 or less annually

Prohibits businesses from reimbursing customers for the fee; violations subject to fines of not less than $1,000 per violation

Preempts county regulations on single-use bags statewide, except in counties with existing ordinances where the fee applies only to paper bags; effective date is July 1, 2030
