Defines three categories of private special education providers: accredited private special education schools/programs, certified or licensed private residential facilities, and nonpublic special education schools/programs.

Requires all private special education providers receiving state funding (directly or through parental reimbursement) to comply with federal and state laws, rules, and regulations.

Mandates that nonpublic special education programs not already accredited by specified organizations must apply for accreditation within 90 days of accepting a state-funded student placed through a hearing officer's decision, court order, settlement agreement, or department placement.

Requires nonpublic programs to provide proof of their accreditation application to the department within the 90-day period.

Takes effect July 1, 2011.
