Clarifies that energy savings generated from performance contracting projects can be used by agencies to fund municipal lease payments for facility improvements without losing their energy budget allocations.

Specifies that the maximum contract term of 20 years begins upon completion of construction rather than at contract execution.

Enables agencies to implement energy savings performance contracting projects more readily by removing budget uncertainty, reducing dependence on general obligation bond appropriations and foreign oil dependency.

Takes effect upon approval.
