Request the Office of the Auditor to conduct an audit of contested child custody proceedings in Family Courts where family violence was alleged, covering cases from January 1, 2004 through December 31, 2010.

Audit will assess whether Family Court judges are correctly applying and enforcing Hawaii Revised Statutes Section 571-46(a)(9)-(14), which establishes criteria for custody and visitation disputes involving family violence.

Judiciary is requested to redact all names of parties, witnesses, attorneys, judges, and other persons from selected proceedings to protect privacy and confidentiality.

Office of the Auditor must submit findings and recommendations to the Legislature no later than twenty days before the start of the 2012 Regular Session.

Certified copies to be transmitted to the Chief Justice of the Supreme Court, Senior Judge of the Family Court, Administrative Director of the Courts, Chief Court Administrators, and the State Auditor.
