Amends HB 1097 HD 1 to increase the rental motor vehicle surcharge tax from $2 per day to $3 per day, effective immediately (removing the temporary rate that was set to expire August 31, 2011).

Maintains existing exemptions for rental vehicles replacing vehicles undergoing repair, with lessor or repair dealer required to retain repair order records for verification for two years.

Preserves tour vehicle surcharge tax rates of $65 monthly for vehicles over 25 passenger seats and $15 monthly for vehicles with 8-25 passenger seats.

Restricts use of all taxes collected under section 251-2 to purposes specified in section 248-9 (state highway fund operations and maintenance), prohibiting transfer to General Fund or other funds except as allowed under section 248-9(3).
