Requires the cost of providing public facilities in the Kakaako makai area to be assessed as a condition of developing real property in the Kakaako mauka area.

Amends section 206E-33(9), Hawaii Revised Statutes, to establish that public facilities costs in Kakaako makai shall be assessed against Kakaako mauka development.

Amends section 206E-35 to require that provisions for the cost of public facilities be included in plans developed by the Hawaii Community Development Authority in collaboration with the Kakaako makai community planning advisory council.

Implements recommendations from a 2010 small business working group to ensure public benefit within the Kakaako community development district by funding public facilities through mauka area development.

Effective upon approval.
