Requires state and county agencies to ensure a public right-of-way is available before approving permits, licenses, or applications for residential, commercial, or lodging development projects that may affect public access to coastal or inland recreational areas.

Applies to development or construction of dwelling units, houses, hotels, apartments, motels, condominiums, and similar structures, as well as improvements to such structures.

Applies to any development project, subdivision, or zoning change that may affect public access to the sea, shoreline, or public recreational areas including beaches, shores, parks, and trails.

Defines "public right-of-way" as an easement or way (including lateral easements along shorelines) over which the public has the right to travel to access public beaches, shores, parks, trails, or other public recreational areas.

Effective date: July 1, 2011.
