Creates a new misdemeanor offense of bullying in the workplace under Chapter 711 of Hawaii Revised Statutes.

Defines the offense as intentionally subjecting an employee or co-worker to abusive conduct that causes physical or psychological harm.

Defines "abusive conduct" as malicious conduct that a reasonable person would find hostile, offensive, and unrelated to an employer's legitimate business interests.

Requires any person convicted of workplace bullying to undergo a court-ordered counseling program.

Takes effect upon approval and does not apply retroactively to proceedings begun before the effective date.
