HB 2462 Summary

• Amends Act 82 (Session Laws of Hawaii 2003) to clarify the definition of "improved public lands" for liability purposes on public lands.

• Adds new definition of "voluntary trails" as trails, paths, or routes created by hikers or users that are not part of official state or county-maintained trails.

• Excludes voluntary trails, ocean and submerged lands, and public beach parks (under section 663-1.56) from the definition of "improved public lands."

• Specifies that improved public lands must be "developed or maintained by the State" for state parks and "developed or maintained by the county" for county park systems.

• Takes effect January 1, 2020.
