Adults (18+) who intentionally or knowingly command, request, or encourage a minor to electronically transmit nude photographs or videos of minors commit a Class C felony offense.

Minors who knowingly use electronic devices to transmit or distribute nude images of minors, or who solicit other minors to do so, commit a misdemeanor offense.

Any person of any age who knowingly possesses a nude photograph or video of a minor that was transmitted or distributed by a minor commits a misdemeanor offense.

Affirmative defense available to possession charges if the person took reasonable steps to destroy or eliminate the nude image of a minor.

Act takes effect upon approval and does not affect penalties incurred or proceedings begun before the effective date.
